US EPA to Rule on Backlog of Small Refinery Biofuel Exemption Requests, Zeldin Says

The Trump administration plans to rule quickly on dozens of small U.S. refineries' pending applications for exemptions from biofuel-blending requirements, the head of the U.S. Environmental Protection Agency told lawmakers on Thursday.
There are 161 applications for exemptions from the U.S. Renewable Fuel Standard pending after the Biden administration refrained from acting on them. The EPA's decision will have significant implications for the multi-billion-dollar credit market that underpins the biofuel program.
"None of these were getting approved at all in the last administration," EPA administrator Lee Zeldin said in a congressional hearing. "We want to get caught up as quickly as we can."
The Renewable Fuel Standard requires refiners to blend biofuels like corn-based ethanol into the nation's fuel supply or buy renewable fuel credits, known as RINs, from those who do. But small refiners can petition the EPA to receive an exemption if they can show financial hardship.
In the first Trump administration, the EPA significantly increased the number of exemptions approved, driving down the price of the renewable fuel credits and angering the Farm Belt, which said the exemptions hurt a program that drove investment in the Midwest.
The Biden administration was critical of the exemptions and essentially let the applications linger without any decisions, resulting in the buildup.
Zeldin's comments came as the EPA sent a proposed rule to the White House for review on the amount of biofuels oil refiners must blend into their fuel beginning in 2026.
It will be one of the first opportunities for the Republican president to show his stance on biofuels policy, which historically has pitted Big Oil and the Farm Belt against each other.
That dynamic shifted recently as a coalition of oil and biofuel groups recommended the EPA, which administers the volumes, propose federal mandates for biomass-based diesel blending for 2026 at 5.25 billion gallons, Reuters previously reported.
That would be a significant increase.
Soybean oil futures on the Chicago Board of Trade fell over 5% on Thursday on rumors the EPA's proposed rule would set biomass-based diesel blending for 2026 at 4.65 billion gallons. Reuters could not confirm that figure.
The EPA was expected to propose a biofuels rule that covers both 2026 and 2027, Reuters previously reported.
The EPA's previous rulemaking on renewable biofuels volume obligations finalized total federal volumes at 20.94 billion gallons in 2023, 21.54 billion gallons in 2024 and 22.33 billion gallons in 2025. READ MORE

The eight newly filed SRE petitions include three petitions filed by HF Sinclair Wood Cross Refining seeking waivers of the 2021, 2022 and 2023 RFS renewable volume obligations (RVOs) for its facility in Wood Cross, Utah; two petitions filed by Alon USA seeking waivers of the 2023 and 2024 RVOs for its facility in Big Spring, Texas; one SRE petition filed by Alon Refning Krotz Springs seeking a waiver of the 2024 RVOs for its facility in Krotz Springs, Louisiana; and two SRE petitions filed by Dalek Refining seeking a waiver of the 2023 and 2024 RVOs for its facility in Tyler, Texas.
The 169 currently pending SRE petitions include two for compliance year 2016; one for compliance year 2017; 38 for compliance year 2018; 27 for compliance year 2019; 28 for compliance year 2020; 18 for compliance year 2021; 14 for compliance year 2022; 16 for compliance year 2023; 19 for compliance year 2024; and six for compliance year 2025.
The EPA took no action to approve or deny any SRE petitions during the past month.
The EPA’s online SRE data dashboard also includes data on small refineries that have opted into the agency’s alternative renewable identification number (RIN) retirement schedule for the 2020 compliance year. According to the EPA’s online data dashboard, 17 small refineries are participating in the alternative RIN retirement schedule, with the total RVO those refineries at 880 million RINs. A total of 540 million RINs have been retired under the alternative retirement schedule as of May 15. The total outstanding RVO is currently at 340 million RINs, according to EPA’s data dashboard. Excerpt from Ethanol Producer Magazine: U.S. EPA Administrator Lee Zeldin on May 14 confirmed the agency will “over the next few months” be completing a rulemaking process to set new Renewable Fuel Standard renewable volume obligations (RVOs).
Zeldin commented on the EPA’s RFS rulemaking plans during a hearing held by the Senate Committee on Appropriation’s Subcommittee on Interior, Environment and Related Agencies to review President Donald Trump’s fiscal year (FY) 2026 budget request for the EPA.
During the hearing, Sen. Deb Fischer, R-Neb., criticized the previous administration for missing RFS regulatory deadlines and setting RVOs for biobased-diesel too low. She asked Zeldin for an update on the EPA’s expected timeline for its next RFS RVO rulemaking.
Zeldin said the agency is “going to be going through the rulemaking process now over the next few months.” He also indicated the EPA plans to meet future statutory RFS rulemaking deadlines.
“Over the course of the next few months there is going to be an opportunity for the public to weigh in during a public comment period before a final decision is made,” he added, noting that many parties are already advocating for increased RVO levels.
Fisher also discussed the issue of E15, asking Zeldin if congressional action is the best solution to ensure the ability to sell E15 year-round. “That is the most durable and easiest solution to this issue,” Zeldin responded.

The letter specifically supports a 2026 Biomass-based Diesel volume of 5.25 billion gallons and increasing volumes for future years, consistent with unified requests by Clean Fuels, other industry partners, and RFS stakeholders. It further asks the President to reject abuse of small refinery exemptions to protect demand for U.S. crops in the biofuel market, which is essential for farmers.
The letter continues, “Set the biomass-based diesel RVO at 5.25 billion gallons in 2026 and at increasing levels in future years (with an equivalent increase in total volumes), reflecting the rapid growth of renewable diesel and soybean processing capacity.”

Excerpt from AgWeb: EPA submitted two major biofuel-related actions to the White House Office of Management and Budget (OMB) for review: its proposed rule for Renewable Volume Obligations (RVOs) for 2026 and beyond under the Renewable Fuel Standard (RFS), along with its final rule to partially waive the 2024 cellulosic biofuel mandate.
The conjecture (not confirmed by EPA or other sources) is that EPA would announce a biodiesel mandate of 4.65 billion gallons, at least 600 million gallons below recommendations from a coalition of oil and biofuels groups. The industry has previously requested a mandate between 5.25 billion and 5.75 billion gallons.
Perspective: 4.65 billion gallons would be a BIG jump from 3.35 billion gallons for 2025 and would be a floor... not a ceiling.
While the forward-looking RVOs draw long-term interest, the agency’s final decision regarding 2024 cellulosic requirements is also awaited. In a proposal issued December 2024, EPA suggested reducing the 2024 cellulosic biofuel volume requirement from 1.09 billion Renewable Identification Numbers (RINs) to 0.88 billion — a cut of 0.21 billion RINs. This partial waiver remained pending even after EPA extended the 2024 compliance reporting period earlier this year.
