California State Motor Vehicle Pollution Control Standards; Greenhouse Gas Regulations; Reconsideration of EPA’s Denial of a Waiver of Preemption

The California Air Resources Board in December 2005 requested a waiver of pre-emption for its greenhouse gas regulations for certain new motor vehicles beginning with Model Year 2009. On March 6, 2008, EPA published a Federal Register Notice Denying a Waiver of Clean Air Act Preemption for California’s 2009 and Subsequent Model Year Greenhouse Gas Emission Standards for New Motor Vehicles.

On January 21, 2009, the California Air Resources Board requested that EPA reconsider its previous waiver denial (see the request). On January 26, 2009, President Obama signed a Presidential Memorandum directing EPA to assess whether denial of the waiver based on California’s application was appropriate in light of the Clear Air Act.

A public hearing concerning this reconsideration was held on March 5, 2009, beginning at 9:30 a.m.  Deadline to submit written comments was April 6, 2009.  READ MORE
